MarbsFUN is a Marbella-focused booking and enquiry website for boats, jet skis, water activities, adventure activities, fishing trips, helicopter tours, and related experiences. MarbsFUN may act as an enquiry, coordination, marketing, or booking support point between customers and independent suppliers, operators, marinas, boat owners, skippers, activity providers, or partners.

Many experiences displayed on the website are provided by independent third-party suppliers. These suppliers are responsible for operating the activity, confirming safety conditions, providing the service, meeting legal or licensing requirements, and applying their own operational rules. MarbsFUN is not responsible for supplier acts, omissions, delays, safety decisions, equipment changes, route changes, or service limitations except where required by applicable law.

Submitting a form, sending a WhatsApp message, or requesting availability does not automatically create a confirmed booking. A booking is only confirmed when availability, price, activity details, supplier conditions, and any required payment or deposit have been accepted and confirmed by MarbsFUN or the relevant supplier.

Prices, durations, routes, capacities, inclusions, extras, deposits, and availability shown on the website are provided for guidance and may change. Final price and availability are confirmed manually before booking. Some prices may vary by date, season, supplier, fuel cost, weather conditions, group size, duration, route, extras, or special requests.

Some bookings may require full payment, partial payment, a supplier deposit, or a security hold. The payment method, amount, deadline, and recipient will be confirmed before the booking is final. Certain activities, such as licensed jet ski rentals or boat charters, may require refundable deposits or damage deposits according to supplier rules.

Cancellation, change, and refund conditions depend on the activity, supplier, date, booking type, and timing of the cancellation request. The applicable cancellation terms should be confirmed before booking. Some bookings may be non-refundable, partially refundable, or subject to supplier fees. Weather-related changes are handled according to supplier policy and safety decisions.

Activities may be changed, delayed, rescheduled, shortened, rerouted, or cancelled due to weather, sea state, wind, safety concerns, technical issues, port restrictions, supplier decisions, or force majeure events. Safety decisions made by suppliers, skippers, guides, monitors, pilots, captains, or operators are final for the activity.

You are responsible for providing accurate information, arriving on time, following supplier instructions, respecting safety rules, bringing required documents, and confirming that all participants meet age, health, licence, and ability requirements. You must not participate under the influence of alcohol or drugs, or in any condition that may create risk for yourself, other guests, staff, or equipment.

Some activities require a valid licence, ID, passport, age confirmation, parental authorisation, deposit, or other documentation. You are responsible for ensuring that you have the required documents before the activity. If you cannot provide required documents, the supplier may refuse the service and cancellation or refund rights may be limited.

Boating, jet skiing, water sports, adventure activities, fishing, helicopter tours, and similar experiences involve inherent risks. These may include weather changes, sea conditions, motion, equipment use, physical activity, slips, falls, impacts, delays, route changes, or other hazards. By booking or participating, you acknowledge these risks and agree to follow all safety instructions.

Suppliers may refuse, stop, or remove participants from an activity if behaviour is unsafe, abusive, disruptive, illegal, intoxicated, or contrary to supplier rules. In such cases, refunds may not be available. Customers may also be responsible for damage caused to equipment, boats, jet skis, vehicles, facilities, or third-party property.

We aim to keep website information accurate and useful, but descriptions, photos, prices, schedules, inclusions, models, capacities, and route details may change. Images may be illustrative, supplier-provided, seasonal, or representative of the activity type. Final details should always be confirmed before booking.

The website may contain links to WhatsApp, Google Maps, Waze, payment platforms, supplier websites, social media pages, or other third-party services. These third parties operate independently and may have their own terms, privacy policies, fees, and technical requirements.

To the maximum extent permitted by applicable law, MarbsFUN is not liable for indirect losses, loss of enjoyment, loss of opportunity, supplier acts or omissions, weather disruption, route changes, delays, equipment substitutions, or events outside our reasonable control. Nothing in these terms excludes liability that cannot legally be excluded.

All website content, branding, layout, text, graphics, and other materials are owned by or licensed to MarbsFUN unless stated otherwise. You may not copy, reproduce, republish, scrape, distribute, or commercially exploit website content without prior written permission.
